1. About these terms
1.1These terms apply to your use of the Benson & Gray website. By using the website, you agree to them. If you don’t agree, please don’t use the website.
1.2We may update these terms from time to time by publishing a new version on the website. The version in force when you use the website applies.
2. Using the website
2.1You may use the website to learn about Benson & Gray, make enquiries and arrange conversations, for your own business purposes.
2.2You must not:
- use the website unlawfully or in a way that infringes anyone’s rights;
- try to gain unauthorised access to the website, its systems or other users’ information;
- introduce malicious code, or interfere with the website’s operation or security;
- use automated tools to scrape, copy or harvest content or contact details from the website, other than ordinary search-engine indexing; or
- submit false, misleading or offensive information.
3. Information on the website
3.1The website provides general information about our services and approach. It isn’t professional advice and doesn’t take your particular circumstances into account. Please don’t act on it without getting advice specific to your situation.
3.2Examples and scenarios on the website, including problem archetypes such as “Kevin’s spreadsheet”, are illustrative and de-identified. They don’t describe any particular client.
3.3We take care to keep the website accurate and current, but some information may become out of date.
4. Enquiries and conversations
4.1Sending an enquiry through the website is a request to meet. We’ll reply to arrange a time or, occasionally, decline, for example where we don’t have capacity or the work isn’t within our specialism.
4.2Introductory conversations are free and without obligation on either side. They don’t create a client relationship, and anything discussed is general in nature until we agree an engagement in writing.
4.3We only provide services under a written agreement, such as an engagement letter, or a statement of work under a master services agreement. That agreement, not these terms, governs the services.
4.4Please share only what’s needed to explain your situation in an enquiry, and don’t include confidential, sensitive or personal information about others. If you’d like to discuss confidential matters before engaging us, we’re happy to sign a mutual confidentiality agreement.
4.5You can reschedule or cancel an arranged conversation at any time by contacting us.
5. Our intellectual property
5.1The website and its content, including text, graphics, photographs, layout, and the Benson & Gray name, monogram, logos and taglines, are owned by or licensed to Benson & Gray Pty Ltd and its related companies, and are protected by intellectual property laws.
5.2You may view, download and print website content for your own information and internal business use. You must not otherwise copy, reproduce, adapt, publish or commercially use it without our written permission.
5.3You must not use our name, monogram, logos or taglines, or anything confusingly similar, without our written permission.
6. What you send us
6.1When you send us an enquiry or other information, you confirm you’re entitled to share it, and you allow us to use it to respond to you and as described in our Privacy Policy.
6.2We treat what you tell us in an enquiry with discretion. A separate confidentiality agreement or our client agreement governs confidential information exchanged in an engagement.
7. Third-party links and services
7.1The website may link to, or use, third-party websites and services, for example a font provider. We aren’t responsible for their content, availability or privacy practices, and a link isn’t an endorsement.
8. Liability
8.1Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any law (including the Australian Consumer Law) that cannot lawfully be excluded or limited.
8.2Subject to clause 8.1, and to the extent permitted by law:
- the website is provided “as is”, and we don’t promise that it will always be available, uninterrupted, error-free or free from viruses; and
- we aren’t liable for any loss arising from your use of, or inability to use, the website, or from reliance on general information on it, except to the extent the loss is caused by our negligence or breach of these terms.
8.3Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to supplying the relevant services again or paying the cost of having them supplied again.
9. Privacy
9.1Our Privacy Policy explains how we handle personal information collected through the website. It forms part of these terms.
10. General
10.1If any part of these terms is invalid or unenforceable, it is read down or severed, and the rest continue to apply.
10.2These terms are governed by the laws of Queensland, Australia, and you submit to the courts of Queensland.
10.3Questions about these terms can be sent to [email protected].
